Terms and Conditions

Welcome to Orbit Virtual Capture ("we," "us," or "our"). These Terms and Conditions govern your use of our real estate photography, virtual tours, and related services in New Zealand. By engaging our services, you ("Client," "you," or "your") agree to comply with these terms.

1. Services Provided

We offer:

  • Real estate photography (interior/exterior)
  • Aerial (drone) photography (subject to CAA regulations)
  • Virtual tours & 3D walkthroughs
  • Floor plans
  • Video tours
  • Editing & post-production services

2. Booking & Scheduling

  • Bookings require a confirmed appointment via email or phone.
  • Cancellations or rescheduling require 24 hours' notice; late cancellations may incur a fee.

3. Client Responsibilities

  • Ensure the property is clean, staged, and accessible at the scheduled time.
  • Ensure the property is free of non necessary individuals
  • Notify us of any hazards (e.g., aggressive pets, construction).
  • Obtain necessary permissions (e.g., drone flights in restricted zones).
  • Provide accurate property details for metadata and listings.

4. Pricing & Payment

  • Prices are as per our current rate card or agreed quote.
  • Payment is due within 7 days of invoice issuance unless otherwise agreed.
  • Late payments may incur interest (2% per month) or suspension of services.

5. Image & Content Usage

  • We retain copyright but grant the Client a non-exclusive license to use images for marketing the listed property.
  • Unauthorized commercial use, resale, or editing of our work is prohibited.
  • We may use photos/videos for our portfolio unless otherwise agreed.

6. Weather & Delays

  • Outdoor shoots may be rescheduled due to poor weather (at our discretion).
  • We are not liable for delays caused by Client unavailability or property issues.

7. Liability & Indemnity

  • We take utmost care but are not liable for accidents, property damage, or image suitability for your needs.
  • The Client indemnifies us against claims arising from their use of our content.

8. Privacy & Data

  • We comply with the NZ Privacy Act 2020.
  • Client data is used only for service delivery and not shared without consent.

9. Disputes & Governing Law

  • Disputes will first be resolved through negotiation.
  • These terms are governed by New Zealand law, with jurisdiction in NZ courts.

10. Amendments

We may update these terms with notice; continued use constitutes acceptance.
